summary of permanent rule changes effective 7-1-06
Permanent
rules were filed with the Secretary of State on June 15, 2006. The
rules take effect July 1, 2006.
This
is a partial list of the permanent
rules and includes only the changes to rules regarding independent
medical exams (IMEs).
OAR
436-010-0265 (2) details the consequences for failing to use a qualified
provider from the director's list.
OAR
436-010-0265 (11) requires the insurer to ensure the IME provider
has an IME survey form to give to the worker on the exam date. See
OAR 436-010-0265 (17) below.
OAR
436-010-0265 (13) Specifies the criteria for inclusion on the list
of authorized providers, states when reduced training may be acceptable,
documents when providers may be removed from the list, and what is
required for training curriculum.
OAR
436-010-0265 (17) requires the IME provider to give the survey form
to the worker after the exam. The survey is a postage-paid (by the
State of Oregon) self-mailer and goes to the Workers' Compensation
Division.
OAR
436-010-0265 (17) eliminates the seven-day time frame for the IME
provider to send the exam report to the insurer.
OAR
436-055-0085 (3) clarifies that, for director approval, a training
curriculum for renewal of claims examiner certification does not need
to cover all of the components listed in OAR 436-055-0085(2) and OAR
436-055-0070(6)(b) allows the 3 hours of training to be completed
in increments.
436-060-0095
(6) requires the insurer to send an IME survey form to the worker
with the appointment notice.
